1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of sereiabeauty.com (the "Site") and the products, services, and content available through it (collectively, the "Services"), operated by Talven Ecom LLC ("we," "us," or "Sereia Beauty"), a limited liability company registered in Wyoming, United States, with a business address at 4300 Biscayne Blvd, Miami, FL 33137, United States.

By accessing the Site, placing an order, creating an account, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

2. Eligibility

You must be at least 18 years old to purchase from the Site. By placing an order, you represent that you are of legal age and that the information you provide is accurate and complete.

3. Products, Pricing and Currency

All products sold on the Site are intended for personal, non-commercial use. Product descriptions, ingredients, and visual representations are provided in good faith but may not be exhaustive. We reserve the right to modify product formulations, packaging, pricing, and availability at any time without prior notice.

Prices are displayed in your local currency where supported (USD, CAD, GBP, AUD, NZD) and include applicable taxes. The exact amount charged is shown at checkout before you confirm your order. We reserve the right to correct pricing errors and to cancel orders placed at obviously incorrect prices; if we cancel such an order, you will receive a full refund.

Promotional offers (including bundle offers such as "Buy 1 Get 1") are valid as displayed at the time of purchase, may be withdrawn or modified at any time, and cannot be applied retroactively to prior orders.

4. Cosmetic Disclaimer

Sereia Beauty products are cosmetics intended to improve the visible appearance of skin. They are not drugs or therapeutic goods, are not intended to diagnose, treat, cure, or prevent any disease, and have not been evaluated for medical purposes by any regulatory authority (including the U.S. FDA, Health Canada, the UK MHRA, the Australian TGA, or Medsafe New Zealand). Results vary from person to person, and customer testimonials reflect individual experiences only. If you have a known skin condition, sensitivity, or allergy, or are pregnant or nursing, consult a healthcare professional before use. We recommend a patch test before first use. Discontinue use and seek medical attention if irritation occurs.

5. Orders and Payment

Submitting an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion, including orders that appear fraudulent, violate these Terms, or that we cannot fulfill. Payment is processed at the time of purchase via the payment methods displayed at checkout. You represent that you are authorized to use the payment method provided. We may use third-party fraud-screening services to protect both you and us.

6. Subscriptions and Recurring Payments

Where we offer products on a subscription basis, the following terms apply:

  • Consent: By starting a subscription, you authorize us (and our payment processor) to charge your payment method on a recurring basis at the frequency and price clearly disclosed at signup, until you cancel.
  • What you'll be told upfront: the recurring price (including taxes), billing frequency, and how to cancel — all shown before you confirm your first subscription order.
  • Cancel anytime: You may pause, skip, or cancel your subscription at any time via your account portal or by emailing contact@sereiabeauty.com. There is no cancellation fee and no minimum commitment unless expressly stated at signup.
  • Billing cutoff: Cancellations made at least 48 hours before the next billing date take effect immediately; later cancellations may take effect from the following billing cycle, in which case the already-billed shipment will still be delivered.
  • Price changes: We will notify you by email at least 30 days before any change to your subscription price, so you can cancel before it takes effect.
  • Failed payments: If a recurring charge fails, we may retry it over the following days and pause your deliveries until payment succeeds.
  • Refunds: Subscription refunds are governed by our Refund Policy.

7. Shipping and Delivery

Shipping terms, destinations, and delivery estimates are described in our Shipping Policy, which is incorporated into these Terms by reference. Delivery estimates are made in good faith but are not guaranteed delivery dates. Risk of loss transfers to you upon delivery; however, packages confirmed lost in transit are replaced or refunded as described in the Shipping Policy.

8. Returns and Refunds

Returns and refunds are governed by our Refund Policy, which is incorporated into these Terms by reference, including our 30-day money-back guarantee with no return shipping required.

9. Your Consumer Rights

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under applicable consumer protection law and that cannot lawfully be excluded, restricted, or modified, including:

  • United Kingdom: your rights under the Consumer Rights Act 2015 (goods must be of satisfactory quality, fit for purpose, and as described) and your 14-day cancellation right for distance purchases under the Consumer Contracts Regulations 2013. Our 30-day guarantee is more generous than, and operates in addition to, these rights.
  • Australia: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
  • New Zealand: your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
  • Canada: your rights under applicable federal and provincial consumer protection legislation, including, for Quebec residents, the Consumer Protection Act (Quebec).
  • United States: any rights under applicable state consumer protection statutes that cannot be waived.

10. Intellectual Property

All content on the Site — including text, images, logos, trademarks, design elements, video, and product photography — is owned by Talven Ecom LLC or licensed to it, and is protected by U.S. and international intellectual property law. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

"Sereia Beauty," "Sereia," "K-Lift," "Sereia Lift," "Sculpt Gel," and "CryoTherm Gold" are trademarks or trade names of Talven Ecom LLC. Unauthorized use is prohibited.

11. User Content

If you submit reviews, photos, testimonials, or other content to the Site or to our social channels, you grant Talven Ecom LLC a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, publish, and display that content in connection with the Services and our marketing. You represent that you own the rights to any content you submit. You may request removal of your content at any time by emailing contact@sereiabeauty.com.

12. Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law.
  • Resell our products without prior written authorization.
  • Attempt to interfere with the security, functionality, or availability of the Site.
  • Use automated systems (scrapers, bots, crawlers) to access the Site without permission.
  • Impersonate any person or misrepresent your affiliation with any person or entity.
  • Abuse our satisfaction guarantee or promotional offers (for example through repeat claims or multiple accounts).

13. Disclaimers and Limitation of Liability

To the maximum extent permitted by applicable law, the Services are provided "as is" and "as available," without warranties of any kind, express or implied, and Talven Ecom LLC, its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services or our products. Our total cumulative liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages — in those jurisdictions, the above limitations apply only to the extent permitted by law, and your rights under Section 9 are unaffected.

14. Indemnification

You agree to indemnify and hold harmless Talven Ecom LLC and its affiliates from any claim, loss, or liability (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Services. This Section does not apply to you to the extent prohibited by the consumer protection law of your place of residence.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles — provided that if you are a consumer habitually resident in the United Kingdom, Australia, New Zealand, or Canada, you also benefit from any mandatory consumer protections of your country of residence, and nothing in this Section deprives you of the right to bring proceedings in the courts of your place of residence where local law gives you that right.

Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved informally by contacting us at contact@sereiabeauty.com — in practice, we resolve nearly all issues this way within a few business days.

If informal resolution fails, and to the extent permitted by the law of your place of residence, disputes shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the seat of arbitration in Miami-Dade County, Florida, and you waive any right to participate in a class action or class-wide arbitration. This paragraph does not apply where prohibited by applicable law (including for residents of Quebec, and for consumers in jurisdictions where mandatory law guarantees access to local courts), and does not prevent either party from seeking injunctive relief in a court of competent jurisdiction for intellectual property infringement.

16. Changes to These Terms

We may revise these Terms at any time by posting an updated version on the Site. The "Last updated" date reflects the most recent changes. Material changes will not apply retroactively to orders already placed. Continued use of the Services after revision constitutes acceptance of the updated Terms.
